Please read these Terms of Service ("Terms") carefully before using the Dashed mobile application ("App") operated by Memento Amari LLC ("Company," "we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Dashed is a personal recipe organization tool for cocktail enthusiasts. The App allows you to:
Dashed functions as a personal digital notebook — similar to tools like Evernote, Pocket, or Apple Notes — where you can store and organize recipe information for your own reference.
You must be at least 21 years of age to use Dashed due to the alcoholic nature of the content. By using the App, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms.
You may be required to create an account to use certain features. You agree to:
4.1 Definition. "User Content" means any information, data, text, or other content that you submit to, import into, or create within the App. This includes recipes you manually enter, recipes imported from URLs you provide, notes, collections, and any other content you add.
4.2 Your Responsibility. You are solely responsible for your User Content. By importing a recipe from a URL or other source, you represent that:
4.3 License Grant. By submitting User Content to the App, you grant us a non-exclusive, royalty-free, worldwide license to store, process, and display the User Content solely for the purpose of providing the App's services to you. We will not sell, publicly distribute, or commercially exploit your User Content.
4.4 Your Library is Private; Discovery is Separate and Opt-In. All recipes, collections, notes, and ratings you create in Dashed are private to you. Your personal recipe library is not shared with other users, published publicly, or made available in any searchable directory.
Dashed operates a separate, opt-in Discovery feature that surfaces public URLs shared to Dashed by opted-in users. The Discovery catalog contains only factual public metadata extracted from those URLs (title, ingredient list, creator name, thumbnail, source URL, tags) and is not derived from, and does not expose, any user's private library. Contribution to Discovery — both retaining extracted URL metadata in the catalog and sending anonymous save signals that power ranking — is off by default and controlled by a toggle in the App's Settings. See our Privacy Policy §2.4 for the full disclosure.
5.1 How Recipe Import Works. When you provide a URL, Dashed extracts structured recipe data — ingredient names, quantities, measurements, glass type, garnish, and preparation steps. This factual data is processed and stored locally on your device for your personal reference.
5.2 What We Extract. Dashed extracts factual recipe information: ingredient names and quantities, preparation techniques and steps, glassware and garnish, recipe attribution (creator name, source, venue). Dashed does not copy or store blog posts, personal narratives, headnotes, photographs, or other creative literary content from source websites.
5.3 Attribution. Dashed preserves and displays attribution for imported recipes, including the original source URL, the recipe creator's name (when available), and the bar, venue, or publication of origin (when available). We encourage you to visit the original source to support recipe creators and discover more of their work.
5.4 No Endorsement. The availability of recipe import does not imply any affiliation with, endorsement by, or partnership with any third-party website or recipe creator. Dashed is an independent tool for personal recipe organization.
6.1 Our Property. The App, including its design, code, features, and branding, is owned by Memento Amari LLC and protected by intellectual property laws. "Dashed" is a trademark of Memento Amari LLC. You may not copy, modify, distribute, or create derivative works of the App.
6.2 Third-Party Rights. We respect the intellectual property rights of others. Recipe ingredient lists and standard preparation instructions are factual information not subject to copyright protection under U.S. law. However, creative expression accompanying recipes (such as personal narratives, photographs, and distinctive literary descriptions) may be protected by copyright.
6.3 Copyright Complaints (DMCA). If you believe that content available through the App infringes your copyright, please see our DMCA Policy for information on how to submit a takedown notice. We respond to valid notices of alleged infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).
7.1 Free Tier. Dashed offers a free tier with limited functionality (5 recipe imports per month).
7.2 Premium Subscription. Premium features are available through an auto-renewing subscription purchased via Apple's In-App Purchase system. Subscription terms, pricing, and billing are governed by Apple's terms and your agreement with Apple.
7.3 Cancellation. You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
7.4 Price Changes. We may change subscription pricing at any time. Price changes will not affect your current billing period and will be communicated in advance.
You agree not to:
9.1 "As-Is" Service. THE APP AND ALL CONTENT ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 Recipe Accuracy. We do not guarantee the accuracy, completeness, or safety of any recipe content. Recipes are provided for informational purposes only. You are responsible for verifying ingredients, measurements, and preparation methods. Always drink responsibly.
9.3 Third-Party Websites. Dashed may display links to third-party websites (such as original recipe sources). We are not responsible for the content, accuracy, or practices of third-party websites.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMENTO AMARI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Memento Amari LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content (including any recipes you import), your violation of these Terms, your violation of any third-party rights (including intellectual property rights), or your violation of any applicable law or regulation.
12.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to conflict of law principles.
12.2 Informal Resolution. Before filing any formal proceeding, you agree to try to resolve the dispute informally by contacting us at legal@dashedapp.com. We will try to resolve the dispute within 30 days.
12.3 Arbitration. Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in Suffolk County, Massachusetts, or any other location to which the parties mutually agree. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
12.4 Class Action Waiver. YOU AND MEMENTO AMARI LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including indemnification, limitation of liability, and dispute resolution) shall survive.
This Section 16 applies to your use of the App when obtained from Apple's App Store or used on an iOS device. You acknowledge that these Terms are between you and Memento Amari LLC only, and not with Apple Inc. ("Apple"). Memento Amari LLC, not Apple, is solely responsible for the App and its content.
